Guardian Storage - Aurora Auction Terms
IMPORTANT ALL ATTENDEES AND BIDDERS MUST READ By participating in the auction, each bidder and attendee agrees to be bound by the following Rules and Regulations. This sale and these Rules and Regulations shall be governed by the laws of the State of Colorado. Venue for any dispute shall lie exclusively in the county where the property is located. The winning bidder purchases the entire storage unit and all contents therein, unless otherwise noted. All payments must be made in cash and made within 24 hours of the end of the Auction Public Sale otherwise the unit will be offered to the next highest bidder. Buyer must remove all contents within 48 hours of payment. Any property remaining after that time shall be deemed abandoned, and Buyer forfeits all rights thereto. Owner may resell or dispose of such property without notice and without refund. You must provide a valid Photo I.D. to the Site Manager. ALL SALES ARE FINAL. All property is sold, AS IS, WHERE IS, with all faults. Owner makes no representations or warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, title, or condition of the contents. Buyer acknowledges that units may contain hazardous, illegal, or perishable items and assumes all responsibility. A cash deposit of $200 is required. The deposit will be refunded only after the unit is completely emptied and left broom clean, as determined by inspection by the Property Manager. Failure to fully clean and vacate the unit within the required time may result in forfeiture of the deposit. No dumpsters are available. The tenant retains the legal right to cure the default and redeem the property at any time prior to completion of the sale in accordance with Colorado law. If the tenant cures prior to receipt of full payment from the winning bidder, the sale shall be canceled without liability to Owner. Owner reserves the right to cancel the sale for any reason. Sales are not concluded until all paperwork is completed, and tenant accounts are verified for any payments received prior to the transaction with the winning bidder at the property. This is a public sale. Owner makes no guarantees or representations regarding the privacy, security, or the confidentiality of your information. Buyer may not resell goods on Owners property. Buyer assumes all risk of injury or loss arising from participation in the sale and removal of contents. Owner shall not be liable for any injury, damage, or loss to persons or property occurring on the premises or relating to the sale, except to the extent caused by Owners gross negligence or willful misconduct. Personal documents and identification materials, including but not limited to birth certificates, passports, and photographs, are not conveyed by the sale and must be returned to the property office. Buyer agrees to indemnify, defend, and hold harmless Guardian Storage, the Owner of the facility, and their respective officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of or relating to the purchase, removal, possession, transportation, or disposition of the Personal Property. All firearms are excluded from sale. Any firearms discovered shall be secured by the Property Manager and transferred to appropriate law enforcement authorities in accordance with applicable law. Buyer agrees to not dispute credit card charges processed through www.storageauctions.com. Owners Employees, family and friends are strictly prohibited from bidding on and buying units at auction public sale. Owner reserves the right to reject any bid, withdraw any unit prior to completion of sale, or impose minimum bid requirements in order to conduct a commercially reasonable sale as required under applicable law. If a unit receives zero bids, the contents shall remain the property of the seller. The seller may, at their sole discretion, dispose of the contents or relist the unit for sale. Any surplus proceeds from the sale, after satisfaction of the lien and reasonable expenses, shall be handled in accordance with Colorado law.
Notice to Bidders
Lien laws must always be followed. The Storage Facility (Guardian Storage - Aurora) reserves the right to cancel or postpone auction in its sole discretion, including for (but not limited to) compliance with applicable lien and other laws and regulations.
All bids on the site are in $10 increments.
There is a non-refundable auction fee for purposes of the staff, paperwork and other logistical expenses to undertake the auction equal to the greater of (i) $10 or (ii) 15% of the unit sale price at auction.
Upon winning an auction you will be automatically charged a down payment of 10% of the unit sales price as a deposit that will be applied toward payment of the unit sales price.
Once the initial payment is collected you will receive an invoice for the remaining balance to be paid directly to the facility. You must have an invoice in order to access the unit.
Buyers must follow the facility’s auction terms. Auction terms are not created by StorageAuctions.com.
StorageAuctions.com does not allow last second bids to win. Bidding in the last two minutes will reset the time clock to 2 minutes, then an additional bid(s) will reset the 2-minute timer.
All sales are final and considered “as is.” Bids are considered a contractual agreement that must be fulfilled.
Units must be completely cleaned out and all trash must be removed from premises. No dumpsters privileges unless location specified.
Failure to fully completely clean out the unit will result in penalties.
